According to the report of Dawn newspaper, Justice Muhammad Ali Mazhar remarked in a decision yesterday that doing complete justice is the first duty of the court and the tribunal.

No person should suffer due to procedural delay or court error

Justice Muhammad Ali Mazhar emphasized that there is a clear principle in this regard that no person should be harmed due to the error of the court or any action of the court should not be biased against anyone, this principle is protected in the broad system of justice. It also indicates the path.

Justice Muhammad Ali Mazhar is part of a 2-judge bench of the Supreme Court headed by Chief Justice of Pakistan (CJP) Umar Atta Bandial which on August 18, 2020 challenged the dismissal of a petition by the Federal Service Tribunal Islamabad. Heard the appeal.

Appellant Abid Jan was dismissed by the Ministry of Defense on May 29, 2019. He filed a departmental appeal on June 28 of the same year but it was not decided in time.

The petitioner then approached the Peshawar High Court (PHC) even though he should have filed an appeal in the Federal Services Tribunal (FST) as he was a government servant.

The Peshawar High Court on 16 June 2020 ruled that the appeal should be treated as a service appeal and referred back to the Federal Services Tribunal.

During the hearing in the Supreme Court, the petitioner’s lawyer Riyaz Hanif Rahi said that the Federal Services Tribunal dismissed the appeal on the basis of limitation rather than merit.

In his judgment, Justice Muhammad Ali Mazhar emphasized that no one should suffer injustice as a result of a court error, but if it does, it should be rectified immediately by making necessary corrections.

Principle of treatment

Justice Muhammad Ali Mazhar said that the principle of redress states that if the court is satisfied that there has been a mistake, the victim should be restored to the position he would have had in the absence of the mistake.

Justice Muhammad Ali Mazhar said that it is the responsibility of the court to correct the wrong done to a party by its own action.

He said that it is a basic principle and principle of justice system that no one should suffer due to procedural delay or court error.

Justice Muhammad Ali Mazhar remarked that the impugned order should not be upheld, in fairness it is an inevitable duty that if any mistake has been made as in this case, it should be rectified without implicating the parties. It should be corrected.

The Supreme Court sets aside the rejection of the appeal by the Federal Service Tribunal and converts it into an appeal

The Supreme Court observed that when the case was taken up as a service appeal and transferred to the Federal Service Tribunal, then it was not permissible to reject the application on the ground of limitation, the proper course was to issue a notice to the respondent. The service appeal should have been decided on merits after giving due opportunity of hearing to the parties.

However, the court set aside the rejection of the appeal by the Federal Service Tribunal and converted the matter into an appeal.

The Supreme Court said that after giving both the parties due opportunity of being heard, the matter was remanded back to the Federal Service Tribunal for decision on appeal.

Human Rights Watch says the Pakistani government is using intimidation, abuse, and detention tactics to force illegal Afghan refugees to return to Afghanistan or deport them.

Amnesty International appealed to the international community to financially support Pakistan to host Afghan refugees and to take responsibility for providing protection to those fleeing persecution in Afghanistan. .
